This Terms of Service Agreement ("Agreement") constitutes a legally binding contract between you ("User", "you" or "your") and Epsilon.gg ("Provider", "we", "us", or "our"). By accessing, registering for, or using any aspect of our Garry's Mod Dark RP service (the "Service"), you agree to be bound by this Agreement, including any amendments or modifications incorporated herein by reference. I. DEFINITIONS
- Service: All digital services, functionalities, features, content, and applications provided by Epsilon.gg for Garry's Mod Dark RP.
- Intangible Items: Virtual goods, in-game privileges, cosmetic enhancements, or other non-physical digital assets provided in exchange for donations.
- Donations: Monetary contributions made by Users in exchange for Intangible Items or services, which shall be deemed non-refundable.

II. ELIGIBILITY AND USER REPRESENTATIONS
Age and Legal Capacity
2.1. You represent and warrant that you are at least 13 years of age (or the minimum age as required by applicable law) and possess the legal capacity to enter into this Agreement.
2.2. If you are accessing or using the Service on behalf of an entity, you represent and warrant that you have the authority to bind such entity to this Agreement.
Accurate Information

Donation Processing

Digital Nature of Items
3.4. You recognize that Intangible Items provided as a result of Donations are digital in nature and cannot be physically returned, exchanged, or refunded.
IV. LICENSE AND LIMITED RIGHTS
Grant of License
4.1. Subject to your compliance with this Agreement, Provider grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
Restrictions
- 4.2.a. Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written consent from Provider;
- 4.2.b. Reverse engineer, decompile, or disassemble any software or components of the Service;
- 4.2.c. Modify, adapt, or create derivative works from the Service or its components without prior written authorization.
V. USER ACCOUNTS AND SECURITY
Account Registration and Security
5.1. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
5.2. You agree to immediately notify Provider of any unauthorized use or security breach related to your account.
Prohibited Activities
- 5.3.a. Unauthorized access to other users' accounts or personal information;
- 5.3.b. Distribution of malware, viruses, or any harmful code;
- 5.3.c. Any conduct that violates applicable law, regulations, or third-party rights.
VI. COMMUNITY GUIDELINES AND CODE OF CONDUCT
Adherence to Community Standards
6.1. You agree to abide by the Community Guidelines as published on our website and any affiliated platforms.
6.2. Provider reserves the right to modify or update the Community Guidelines at its sole discretion, and it is your responsibility to remain informed of such changes.
Behavioral Expectations
6.3. You shall not engage in harassment, hate speech, or any form of abusive behavior towards other Users.
6.4. You shall refrain from posting content that is unlawful, harmful, or in violation of intellectual property rights.
Monitoring and Enforcement
6.5. Provider reserves the right to monitor all User activity on the Service and to take appropriate measures, including the removal of content or suspension of accounts, to enforce compliance with these guidelines.
VII. TERMINATION, SUSPENSION, AND REMOVAL
Right to Terminate or Suspend Access
7.1. Provider reserves the absolute right, at its sole discretion, to limit, revoke, or suspend any User’s access to the Service, with or without cause or notice.
Immediate Removal for Rule Violations
7.2. Without limiting the foregoing, Provider may immediately terminate your access and remove you from all servers and affiliated platforms if you breach any term of this Agreement, violate Community Guidelines, or engage in any conduct deemed detrimental to the Service or other Users.
7.3. Such termination or removal shall be effective immediately upon determination or notice, and Provider shall not be liable for any damages, losses, or consequences resulting from such action.
Effect of Termination
7.4. Upon termination of your access, all rights granted to you under this Agreement shall immediately cease, and you must promptly discontinue all use of the Service.
7.5. Termination of your access does not relieve you of any obligations incurred prior to termination, including any payment obligations.
VIII. MODIFICATIONS AND UPDATES
Amendments to the Agreement
8.1. Provider reserves the right to modify, update, or amend this Agreement at any time, with or without notice.
8.2. Continued use of the Service after any modifications constitutes your acceptance of the revised terms.
Service Updates
8.3. Provider may, at its discretion, implement updates, improvements, or changes to the Service. Such changes may include modifications to features, functionalities, or any part of the Service, and will not be subject to separate consent.
IX. DISCLAIMER OF WARRANTIES
"AS IS" Basis
9.1. The Service is provided on an "as is" and "as available" basis without any warranties of any kind, whether express, implied, or statutory.
No Warranty of Error-Free Operation
9.2. Provider disclaims all warranties regarding the Service’s uninterrupted operation, error-free performance, or compliance with your requirements.
Disclaimer of Implied Warranties
9.3. All implied warranties, including, but not limited to, warranties of merchantability and fitness for a particular purpose, are hereby disclaimed to the fullest extent permitted by applicable law.
X. LIMITATION OF LIABILITY
Exclusion of Damages
10.1. Under no circumstances shall Provider be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, revenue, or data, arising out of or in connection with your use or inability to use the Service.
Maximum Liability
10.2. Provider’s aggregate liability, whether in contract, tort, or otherwise, shall in no event exceed the amount paid by you, if any, for accessing the Service.
Assumption of Risk
10.3. You expressly assume all risks associated with the use of the Service and agree that your use is entirely at your own risk.
XI. INDEMNIFICATION
User Indemnity
11.1. You agree to indemnify, defend, and hold harmless Provider and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of this Agreement, or your infringement of any rights of any third party.
XII. DISPUTE RESOLUTION AND GOVERNING LAW

12.1. This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Provider is organized, without regard to its conflict of law principles.
Arbitration
12.2. Any disputes arising out of or relating to this Agreement or the Service shall be resolved exclusively by binding arbitration in accordance with the rules of the applicable arbitration body.
12.3. The arbitration proceedings shall be conducted in the language of the Service and held in a mutually agreed-upon location, or if no agreement can be reached, in a location designated by the arbitration authority.
Class Action Waiver
12.4. To the fullest extent permitted by applicable law, you and Provider agree that any dispute resolution proceedings shall be conducted solely on an individual basis and not as a class action.

XIV. MISCELLANEOUS
No Waiver
14.1. The failure of Provider to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
Assignment
14.2. Provider reserves the right to assign or transfer its rights and obligations under this Agreement at its discretion. You may not assign or transfer any rights or obligations under this Agreement without the express written consent of Provider.
Notices
14.3. Any notices or communications required or permitted under this Agreement shall be provided in writing via electronic mail or other reasonable means, and shall be deemed given upon receipt.
Force Majeure
14.4. Provider shall not be liable for any failure to perform its obligations under this Agreement if such failure is caused by circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, or government actions.
XV. ACKNOWLEDGEMENT AND CONSENT
By accessing or using the Service, you hereby acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. You further agree that your continued use of the Service constitutes your ongoing acceptance of any modifications to this Agreement.
